Welcome to viralstud.io ("we," "us," or "our"). We respect your privacy and are committed to protecting your personal data. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit or use our platform (the "Service"). By accessing or using our Service, you agree to the terms of this Privacy Policy. If you do not agree, please do not use our Service.

1. Who We Are

  • Owner: Ángel Sánchez Guerrero (an individual residing in Spain)
  • Platform: viralstud.io (the "Service")
  • Contact: [email protected]

Although we operate from Spain, we welcome users from around the world, including those located in the United States.

2. Information We Collect

2.1 Information You Provide Voluntarily

  • Account Registration: When you create an account via Clerk, we may receive your name, email address, and password. If you choose to log in using a third-party provider (such as Google), we may receive basic profile information (e.g., name, email) from that service.
  • User-Generated Content: When you upload videos, photos, or other content to our Service, that content may include personal information if, for instance, you or others appear in the media.

2.2 Information Collected by Third Parties on Our Behalf

  • Authentication (Clerk)
    • Clerk may collect certain technical information (e.g., device type, operating system, browser type, IP address) for security, fraud prevention, and user authentication.
    • Clerk processes the personal data necessary to create and maintain your account.
  • Payment Information (Stripe)
    • We use Stripe to process subscription payments. Stripe may collect your payment card details, billing address, and other necessary information.
    • We do not see or store your full payment card information.
    • Stripe's use of your personal data is governed by Stripe's own privacy policy.
  • Analytics (PostHog)
    • We use PostHog to help analyze how users interact with our Service.
    • Limited technical information (e.g., anonymized IP addresses, browser type, pages visited) may be collected.

2.3 Information Stored Automatically

  • Cloudflare R2: Your user-generated content (videos, images, etc.) is stored on Cloudflare R2. While we do not actively mine or analyze your content, it is hosted by a third-party infrastructure provider on our behalf.
  • Log Files: Our servers may automatically collect certain information, such as your IP address, access times, and pages viewed. This is typically for debugging and security purposes.

3. How We Use Your Information

We may use the information we collect for various purposes, including to:

  • Provide and Maintain the Service: Create and manage your account, host and display your content, process your subscriptions, and facilitate secure authentication.
  • Customer Support: Respond to inquiries, send administrative or account-related information, and address technical issues.
  • Analytics and Improvements: Monitor usage, enhance user experience, and develop new features.
  • Compliance and Legal: Comply with applicable laws, respond to legal requests, and protect our rights and interests.

4. Legal Bases for Processing

If you are located in the European Economic Area (EEA) or the United Kingdom, we process your personal data under the following legal bases:

  • Performance of a Contract: We need certain data to provide our Service under our Terms of Service.
  • Legitimate Interests: We use certain data (e.g., analytics) to improve and secure our Service.
  • Consent: Where required by law (e.g., marketing), we will obtain your consent.

5. How We Share Your Information

We do not sell or rent your personal information to third parties. However, we may share certain information in the following circumstances:

  • Service Providers: We share data with third-party vendors who help us operate or improve the Service (e.g., Clerk for authentication, Stripe for payments, PostHog for analytics, Cloudflare R2 for storage).
  • Legal Compliance: We may disclose information to comply with a legal obligation, protect our rights, or respond to lawful requests (e.g., subpoenas, court orders).

6. Data Retention

  • User-Generated Content: We store user-uploaded content in Cloudflare R2 indefinitely, unless you request deletion or your account is terminated.
  • Account Information: We retain your account data (name, email) as long as your account remains active or as needed to provide the Service. If you request deletion, we will remove or anonymize your data in accordance with applicable law and our internal policies.
  • Payment Information: Stripe will retain financial records in accordance with their legal and compliance obligations.

7. Children's Privacy

Our Service is not intended for children under the age of 13, and we do not knowingly collect personal information from them. If you are under 13 (or the age of majority in your jurisdiction), you may only use the Service with the involvement of a parent or guardian. If we become aware that we have collected personal information from a child without proper parental consent, we will take steps to delete such information promptly.

8. Security Measures

We employ a variety of security measures to protect your information, including:

  • SSL/TLS Encryption: Data transmitted to and from our Service is encrypted in transit.
  • Best Practices: We review our information collection, storage, and processing practices regularly.
  • Vendor Due Diligence: We use reputable third-party service providers who also maintain security best practices.

No method of transmission over the Internet or electronic storage is completely secure, so we cannot guarantee its absolute security.

9. International Data Transfers

Because we are based in Spain but serve users around the world (including the United States), your information may be transferred to and processed on servers located outside of your country of residence. When we transfer data outside the EEA or the UK, we rely on appropriate safeguards, such as Standard Contractual Clauses, to ensure an adequate level of data protection.

10. Your Rights

Depending on where you live, you may have the right to:

  • Access the personal data we hold about you
  • Request Correction or Deletion of your data
  • Object to or Restrict certain processing of your data
  • Withdraw Consent at any time if processing is based on consent

If you wish to exercise any of these rights, please contact us at [email protected]. We will respond in a timely manner in accordance with applicable laws.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, comply with legal requirements, or for other operational reasons. If we make material changes, we will post a notice on our site or notify you by email (if we have your email address on file). Please review this Privacy Policy periodically for the latest information on our data practices.
